Cookies are small text strings that the sites visited by the user send to his terminal, where they are stored to be then transferred to the same sites at the next visit of the same user. In the course of navigation the user can also receive cookies on his terminal that are sent from different web pages (see Provv. Privacy 8 May 2014, n.229). In order to achieve a correct regulation of such devices, it is necessary to distinguish them according to the purposes pursued by those who use them.
TECHNICAL COOKIES
Technical cookies are those used for the sole purpose of "transmitting a communication on an electronic communication network, or to the extent strictly necessary to the provider of a service of the information society explicitly requested by the subscriber or user to provide this service" (see art. 122, paragraph 1, of the Code and Prov. n. 229/2014).
They can consist of browsing or session cookies, which guarantee the normal navigation and use of the website (for example, a purchase or authentication to access restricted areas).
The prior consent of users is not required for the installation of such cookies.
PROFILATION COOKIES
Profiling cookies are intended to create user profiles and are used in order to send advertising messages in line with the preferences expressed in the context of web browsing.
Given their invasiveness to the user, prior consent is required to their installation as provided for in Article 122 of the Code.
ANALITICAL COOKIES
They are used to monitor user use of the website by providing statistical reports that can support the site publisher in its optimization. One of the most widely used tools for web analytics is "Google Analytics", a Google Inc service. through which you can collect navigation statistics. The Guarantor Authority has clarified that these cookies can be framed between technological ones where the IP address is anonymized (also partially) and the sharing of information with Google is deleted. Otherwise, these types of cookies are associated with profiling.
Each type of cookie can be first-party (i.e. processed and managed directly by the owner of the website) or third-party (when installed and acquired by different subjects).
Third-party cookies include social plugins, i.e. those components that allow integration with social media (such as Facebook, Twitter, Google+, LinkedIn, Pinterest, Tumblr etc) that operate through the website, where they generate cookies.
